Welcome to Guessong. By downloading, accessing, or using our mobile application, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using Guessong, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our application.

2. Description of Service

Guessong is a music guessing game that allows users to:

• Listen to song snippets and guess the song title
• Participate in daily challenges
• Play multiplayer games with friends
• Track progress through levels and leaderboards
• Earn and spend in-game currency (diamonds)
• Purchase premium subscriptions for enhanced features

3. User Accounts

To access certain features, you must create an account. You may register using:

• Email and password
• Google Sign-In
• Apple Sign-In

You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

You may only maintain one account. Creating multiple accounts to abuse game mechanics or circumvent restrictions is prohibited.

4. User Conduct

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the service or servers
• Use cheats, exploits, automation software, bots, or any unauthorized third-party tools
• Harass, abuse, threaten, or harm other users
• Impersonate any person or entity
• Share your account credentials with others
• Attempt to reverse engineer or decompile the application
• Exploit bugs or glitches (report them to us instead)

5. Free and Premium Tiers

Free Tier

Free users have access to basic features with the following daily limits:

• 25 games per day (combined random and category games)
• 2 playlist challenges per day
• 2 multiplayer room creations per day (every room is 5 songs)
• Advertisements displayed during gameplay

Daily limits reset at midnight (UTC). We may adjust these limits; the ones in force are always the ones the app shows you.

Premium Subscription

Premium subscribers enjoy enhanced features:

• Unlimited games per day
• Unlimited multiplayer room creations
• Ad-free experience
• Exclusive features and content

6. Subscription Plans and Pricing

We offer the following subscription plans:

Prices may vary by region and are subject to change. Current prices are always displayed in the app before purchase.

Subscription Terms

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in the account settings of the store you installed the app from
• No refunds for partial subscription periods

7. In-Game Currency (Diamonds)

Earning Diamonds

You can earn diamonds through:

• Watching advertisements
• Daily bonuses and rewards
• Completing achievements
• Purchasing diamond packs
• Opening the daily chest, which can also award a free hint, an XP boost, or a streak freeze
• Solving the daily puzzle and completing daily challenges

Using Diamonds

Diamonds are spent on hints during gameplay, on the entry fee for events that charge one, and on a streak freeze. Hint costs:

Diamond Purchase Terms

• Diamond purchases are processed by the store you installed the app from
• Purchased diamonds are non-refundable except as required by law
• Diamonds have no real-world monetary value and cannot be exchanged for cash
• Diamonds are not transferable between accounts
• We reserve the right to modify diamond prices and hint costs

8. Levels and Experience Points (XP)

Players earn XP based on:

• Correct guesses
• Speed of response
• Maintaining streaks
• Number of attempts used

XP contributes to your level progression. Levels are displayed on leaderboards and your profile. We reserve the right to adjust the XP system for game balance.

9. Multiplayer and Social Features

Multiplayer Rooms

• You can create game rooms and invite friends
• Room invitations expire after 10 minutes
• Room creators can select music categories
• All players in a room must follow these Terms of Service

Friends System

• You can send and receive friend requests
• Your online status is visible to friends
• Friend-related statistics are tracked (games played together, wins/losses)

Leaderboards

Your username, level, and statistics may appear on public leaderboards. By using the service, you consent to this display.

Community

The Community tab lets you write posts and comments that everyone using Guessong can read. What you post is public and is shown with your username and avatar.

There is no tolerance for objectionable content or abusive behaviour. Do not post anything that is:

• Harassing, threatening, hateful, or targeted at a person or group
• Sexually explicit, violent, or otherwise obscene
• Illegal, or an encouragement to do something illegal
• Someone else's personal information, posted without their consent
• Spam, advertising, or an attempt to defraud other players
• Impersonating another person, an artist, or Guessong itself

You keep ownership of what you write. By posting it you give us permission to display it in the app and to store it for as long as it remains posted.

Reporting, Blocking and Moderation

• Report — every post and comment has a report option. Reports reach us directly.
• Block — you can block or mute any account, which hides their content from you and stops them contacting you.
• Our response — we review reported content and act on it within 24 hours: content that breaks these rules is removed, and the account that posted it may be suspended or terminated.
• Contact — you can also reach us at guessongapp@gmail.com or through the Contact screen in the app.

We may remove content or restrict an account without notice where the content is unlawful or presents a risk to other players. We are not obliged to keep anything you post, and we may remove it at our discretion.

10. Third-Party Content and Services

Guessong uses music content provided by Apple Music and Deezer APIs. The music, song titles, artist names, and album artwork are the property of their respective owners. We do not claim ownership of any third-party content.

By using Guessong, you also agree to:

• Apple Media Services Terms
• Deezer Terms of Use

11. Intellectual Property

All content, features, and functionality of Guessong (excluding third-party music content) are owned by us or our licensors, including:

• The Guessong name, logo, and branding
• App design and user interface
• Game mechanics and features
• Software code and algorithms

You may not copy, modify, distribute, sell, or create derivative works without our written permission.

12. Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violations of these Terms of Service
• Cheating or exploiting game mechanics
• Fraudulent activity
• Abusive behavior toward other users
• Any other reason at our sole discretion

Upon termination:

• Your right to use the service immediately ceases
• Unused diamonds and subscription time are forfeited
• Your game progress and statistics will be deleted

Account Deletion by User

You may delete your account at any time through the app settings. Account deletion is permanent and cannot be undone. All associated data, including diamonds, progress, statistics and your purchase and subscription records, will be permanently deleted.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

• The service will be uninterrupted, error-free, or secure
• Any errors will be corrected
• The service will meet your expectations
• Your game progress or virtual items will be preserved

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of game progress, virtual items, or account data
• Any damages resulting from unauthorized access to your account
• Service interruptions or errors

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights

16. Changes to Terms

We may modify these terms at any time. We will notify users of significant changes through:

• In-app notifications
• Email (if provided)
• Updating the "Last updated" date

Continued use of the service after changes constitutes acceptance of the new terms.

17. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.

18. Dispute Resolution

Any disputes arising from these terms or your use of the service shall be resolved through:

• Good faith negotiation
• Mediation
• Binding arbitration (if required)

You agree to waive any right to participate in class action lawsuits against us.

19. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

20. Service Provider and Contact

Guessong is developed and run by Muharrem Bektaş Çimen, and these terms govern your use of it.

• Developer account: Seray Çatıkkaş Çimen, the name the app is published under on the App Store (shown there as Seray Catikkas Cimen). A Google Play release is planned

Subscriptions and diamond purchases are sold under their own terms by the store you installed the app from, through that developer account, and are managed and refunded through your account with that store rather than by us.
